"Double Dipping" Terms and Conditions

TERMS AND CONDITIONS

BY REGISTERING IN the double dipping program WITH blue rewards AND emcan, YOU AGREE TO THE double dipping TERMS.

These terms and conditions (the “Double Dipping Terms”) govern Double Dipping Program with Blue Rewards and EmCan (“Double Dipping Program”). By registering for the Double Dipping Program by successfully linking a Blue Rewards Account with an EmCan Account (an “Eligible Member”) and receiving and redeeming benefits of the Double Dipping Program including, without limitation, Points in the Blue Rewards Program (“Blue Points”) and EmCan Points in the EmCan loyalty Program (“EmCan Points”), each registrant agrees that he/she has read, understood and accepted these Double Dipping Terms. Blue Rewards and EmCan may at any time amend, modify or supplement these Double Dipping Terms, and continued participation in the Double Dipping Program will constitute an Eligible Member’s acceptance of any such amendment, modification or supplementation.

1. Linking your Blue rewards account with emcan

  • 1.1 Eligibility. Linking a Blue Rewards Account with an EmCan Account requires existing active membership in both the Blue Rewards Program as well as the Emcan Program. Membership into both Programs may be obtained for free by installing the respective apps and completing the registration process.
  • 1.3 Linking. An individual with both EmCan and Blue Rewards mobile applications may link their accounts through either of the respective apps. Linking will only be possible if the registered mobile phone numbers are identical in both Blue Rewards and EmCan loyalty Program.
  • 1.4 Timing.
    • 1.4.1. Posting. Any Points earned through this Double Dipping Program will be credited instantly.
  • 1.5 Program Terms.
  • 1.6 Double Dipping. A Member who has successfully linked their Blue Rewards Account with their Emcan Account (“Eligible Member”) will only be able to double dip i.e. earn rewards in both the Programs on Qualifying Transactions at Participating Al Futtaim Group Brands and Participating Emarat Petrol Stations.
  • Eligible Members may benefit from the Services or receive any other Program benefits under these Double Dipping Terms: (a) if the Member’s Blue Rewards Account and Emcan Account were linked successfully (b) if the Qualifying Transaction has been made after successfully linking the Blue Rewards Account with Emcan Account; and (c) if the Qualifying Transactions were at the Participating Al Futtaim Group Brands and Emarat petrol stations.
  • 1.7 Definitions. To the extent that terms are capitalised in these Double Dipping Terms, the terms have the meanings specified in the Terms of Use and Privacy Policy of Blue or the Emcan Terms and Conditions and Privacy Policy, as applicable.
    • Blue Rewards Account means a Blue Rewards account held by a Blue Rewards program member
    • Cashback is a financial incentive whereby a portion of the purchase price is returned to the member after the transaction is completed.
    • Double Dipping Program means a loyalty initiative where members can earn rewards or benefits simultaneously from two different sources or actions.
    • Emcan Account means an EmCan Account held by an EmCan member
    • Emcan Loyalty Program means a customer rewards program by Emarat Petrol Station, allowing members to earn and redeem points for purchases at participating stations via the EmCan App
    • Emcan Terms and Conditions means EmCan’s terms and conditions found in the following link: https://www.emcan.com/en/terms-conditions
    • Terms of Use of Blue means the terms of the Blue Rewards program set out on https://www.mybluerewards.com/rewards/terms-and-condition#uae as amended from time to time by Blue in its absolute discretion
    • Participating Al Futtaim Group Brands refers to Al Futtaim Group physical retail stores in the United Arab Emirates that are participating in the Double Dipping Program. These are the following: AAPE, ACE, Al Futtaim Watches and Jewellery, The Watch House, Champs Outdoors Dubai Festival City, Healthhub Clinic, Healthhub Pharmacy, IKEA, KIABI, Maje, Marks and Spencer, Sandro, Tedbaker, Toys R Us, Watsons.
    • Participating Emarat Petrol Stations mean all of Emarat petrol stations participating in the EmCan Loyalty Program as nominated by Emarat.
    • Qualifying Transaction shall mean all spends that qualify for Cashback accrual under the Blue Rewards Program at Participating Al Futtaim Group Brands and spends on/in fuel, lube express, carwash, Bakeria, Freshplus and Café Arabicca that qualify for Emcan Points accrual under the EmCan Loyalty  Program for any purchases made after successfully linking the Blue Rewards and Emcan Accounts

2. Double dipping – blue rewards.

  • 2.1 Earning Blue Points. An Eligible Member will earn one Blue Point for every four United Arab Dirham spent on a Qualifying Transaction at Participating Emarat Petrol Stations in addition to earning EmCan Points in accordance with the Emcan Terms and Conditions and Privacy Policy.
  • 2.2 Emarat Petrol Stations. An Eligible Member will earn one Blue Point for every four United Arab Dirham spent and EmCan Points in accordance with the Emcan Terms and Conditions and Privacy Policy on all Qualifying Transaction on the following spends at Bakeria, Freshplus, Café Arabicca, carwash, fuel and lube express.

3. Double dipping - EmCan.

  • 3.1 Earning EmCan Points. An Eligible Member will earn one EmCan Point for every four United Arab Dirham spent on Qualifying Transactions in addition to earning Cashback on all spends at all Participating Al Futtaim Group Brands in accordance with the Terms of Use and Privacy Policy of Blue
  • 3.2 Participating Brands. An Eligible Member will earn Cashback on all spends and one Emcan Point for every four United Arab Dirham spent at the following Participating Brands of Al Futtaim in the United Arab Emirates only: AAPE, ACE, Al Futtaim Watches and Jewellery, The Watch House, Champs Outdoors Dubai Festival City, Healthhub Clinic, Healthhub Pharmacy, IKEA, KIABI, Maje, Marks and Spencer, Sandro, Tedbaker, Toys R Us, Watsons.

4. Refunds.

4.1. Refunds for Qualifying Purchases at Participating Al Futtaim Group Brands and Participating Emarat Petrol Stations will be handled as per the standard refund policies and terms and conditions of the respective Participating Al Futtaim Group Brands, Emarat’s standard terms and conditions and refund policies, Terms of Use of Blue and EmCan Terms and Conditions.

4.2. Refunds and EmCan Points at Participating Al Futtaim Group Brands:

4.2.1     If an Eligible Member receives a refund for a Qualifying Purchase at a Participating Al Futtaim Group Brand, EmCan Points that were awarded on that transaction will be reversed.

4.3. Refunds and Blue Points at Participating Emarat Petrol Stations:

4.3.1     If an Eligible Member receives a refund for a Qualifying Purchase at a Participating Emarat Petrol Station, Blue Points that were awarded on that transaction will be reversed.          

5. TERMINATION

  • 5.1 Termination by an Eligible Member. An Eligible Member may terminate his/her participation in the Double Dipping Program at any time by delinking or deleting their account through the respective applications.
  • 5.2 Termination by Blue Rewards or EmCan. Blue Rewards or EmCan may suspend benefits or terminate an Eligible Member’s ability to participate in Double Dipping Program at any time with immediate effect and without written notice, for any reason and in their sole discretion including, without limitation, if:
    • 5.2.a. The Eligible Member’s Blue Rewards Account or EmCan Account has been suspended or terminated for any reason;
    • 5.2.b. The Eligible Member is no longer has an existing membership in the Blue Rewards Program and existing membership in the EmCan Program; or
    • 5.2.c.
      • Blue Rewards or EmCan believes the Eligible Member has violated the Terms of Use of Blue Rewards  or the Emcan Terms and Conditions and Privacy Policy
      • Acted in a manner inconsistent with applicable laws, regulations and ordinances;
      • Failed to pay any Qualifying Transaction amount when due to an Al Futtaim Brand and or Emarat Petrol Station;
      • Acted in an inappropriate, fraudulent, abusive or hostile manner;
      • Breached or violated any of these Double Dipping Terms; or
      • Engaged in any misconduct or wrongdoing in connection with Blue Rewards and Emcan.

6. OTHER PRINCIPLES.

  • 6.1 Modification of Double Dipping Terms. Blue Rewards and EmCan may change the Double Dipping Terms at any time, for any reason and without notice.
  • 6.2 Termination of the Double Dipping Program. Blue Rewards or EmCan may terminate the Double Dipping Program at any time. An Eligible Member may not earn Points for Qualifying Purchases at Participating Brands of Al Futtaim and participating Emarat Petrol Stations after the termination of the Double Dipping Program.
  • 6.3 Benefits Subject to Availability and Modification. All double dipping benefits, offers and awards are subject to availability and may be changed at any time without notice.
  • 6.4 No Sale or Transfer. Double Dipping benefits may not be sold, bartered or transferred (other than by Blue Rewards, EmCan or their respective agents). Any attempted transfer, sale or barter will be void. Blue Rewards, Emcan and their partners may refuse to honour or recognize any benefits which such party believes may have been transferred, sold or bartered.
  • 6.5 Eligible Member Data. In the event an Eligible Member has agreed, read and checked the Blue Rewards or EmCan Privacy Policy upon Linking their accounts, Blue Rewards and EmCan may, in accordance with applicable law, each receive data regarding the Eligible Member from the other party including, without limitation, mobile phone numbers, Blue ID, EmCan ID and transactional data such as the transaction: ID, date, time, and amount as further detailed below under clause 6.5.a and 6.5.b.
    • 6.5.a. Blue Rewards may receive data regarding Eligible Members from Emcan, which may be used by Blue Rewards in connection with the Double Dipping Program including, without limitation, to verify account information, award Blue Points in the Blue Rewards Program, and provide Double Dipping Program benefits. The data provided to Blue Rewards from EmCan may include an Eligible Member’s mobile phone number, EmCan ID, transactional data such as transaction ID, date and time, amount, linking date and time and will be used by Blue Rewards in accordance with the Terms of Use and Privacy Policy of Blue.
    • 6.5.b. EmCan may receive data regarding Eligible Members from Blue Rewards which may be used by Emcan in connection with the Double Dipping Program including, without limitation, to verify account information, to award Points, and to enable Emcan to provide Double Dipping Program benefits. The data provided to Emcan from Blue Rewards may include an Eligible Member’s mobile phone number, Blue ID and transactional data such as transaction ID, date and time, amount, linking date and time and will be used by Emcan in accordance with the Emcan Terms and Conditions and Privacy Policy.
  • 6.6 No Warranties or Representations, Express or Implied. To the extent permitted by applicable law, Blue Rewards or EmCan make no warranties or representations, either expressed or implied with respect to type, quality or fitness of goods or services provided through the Double Dipping Program.
  • 6.7 Indemnification. You agree to indemnify and hold Blue Rewards, EmCan, Participating Al Futtaim Group Brands and Emarat and their respective subsidiaries, affiliates, officers, directors, agents and employees harmless from any claim or demand, including reasonable attorney's fees, made by any third party due to or arising out of your breach of these terms and conditions or your violation of any law or the rights of a third party.
  • 6.8 Waiver. Waiver of any breach of these Double Dipping Terms by any Eligible Member will not constitute a waiver of any other prior or subsequent breach of these Double Dipping Terms.
  • 6.9 Limitation of Liability. IN NO EVENT WILL THE AL FUTTAIM GROUP OR BLUE REWARDS, EMARAT OR EMCAN OR ANY PARTICIPATING AL FUTTAIM GROUP BRAND AND PARTICIPATING EMARAT PETROL STATIONS BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, EXEMPLARY, PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ANY KIND, WHETHER BASED IN CONTRACT, TORT OR OTHERWISE, WHICH ARISE OUT OF OR ARE IN ANY WAY CONNECTED WITH THE DOUBLE DIPPING PROGRAM OR THESE DOUBLE DIPPING PROGRAM TERMS.
  • 6.10 Choice of Law and Venue. disputes arising out of or related to the Double Dipping or these Double Dipping Terms will be handled individually without any class action, and will be governed by, construed and enforced in accordance with the applicable laws of United Arab Emirates without regard to its conflicts of law rules. The exclusive jurisdiction for any claim or action arising out of or relating to these Double Dipping Terms or the Double Dipping Program with Blue Rewards and EmCan may be filed only in the United Arab Emirates.
  • 6.11 Trademarks. Al Futtaim and Blue Rewards and their respective logos are the trademarks of Al Futtaim or its affiliates. Emarat and EmCan are the trademarks of Emarat.
